Litigant in Person Costs
We regularly deal with the legal costs for individuals, companies or other corporations that have acted on their own behalf in legal proceedings without a legal representative. We are experienced in explaining issues to litigants in person in a digestible form and guiding them throughout the whole legal costs process.
If a costs order has been made against a litigant in person, we can help them reduce their liability for legal costs, usually by preparing detailed points of dispute and negotiating a reduction to the costs claimed.
On the other hand, when a litigant in person has been awarded their costs, we help them recover their legal costs by preparing a detailed bill of costs and serving the same on the opponent. Whether we are instructed to recover legal costs for receiving parties or reduce legal costs for paying parties, we always provide our clients with pragmatic advice and strategic recommendations at no additional charge, and we obtain outstanding results.
What is a litigant in person?
Part 46.5 of the Civil Procedure Rules explains that a litigant in person includes a company or other corporation which is acting without a legal representative; and any of the following who acts in person (except where any such person is represented by a firm in which that person is a partner) –
(i) a barrister;
(ii) a solicitor;
(iii) a solicitor’s employee;
(iv) a manager of a body recognised under section 9 of the Administration of Justice Act 1985; or
(v) a person who, for the purposes of the 2007 Act, is an authorised person in relation to an activity which constitutes the conduct of litigation (within the meaning of that Act).
Recovering legal costs for a litigant in person
According to the Litigants in Person (Costs and Expenses) Act 1975, a litigant in person may be able to recover sums in respect of any work done, and any expenses and losses incurred, by the litigant in or in connection with the proceedings to which the order relates. This Act applies to all civil and family courts and certain tribunals.
The standard hourly rate for work undertaken by a litigant in person is £19.00 per hour.
A litigant in person can also recover costs where they have been represented by a lawyer for only part of the proceedings. In this instance, the litigant in person can recover costs for the work undertaken whilst not represented.
